In New South Wales it is actually not illegal to be a bystander at an Illegal Street Racing meet. While it is frowned upon by much of the community, attending an illegal street race is perfectly legal as long as you have no involvement other than just looking on.
This then made it open to compensation if a spectator is hit at an illegal meet. Below is what a Judge from the Anthony Assaf case said in handing down his compensation to be paid by illegal street racer Matthew Simon Prykaza for the crash in 2005 where Anthony Assaf ended up with a broken leg.
"The plaintiff's conduct might be open to community disapproval but it was not a crime to attend such a race meeting," the judge said.
Parliament had apparently chosen not to make spectators at an illegal street race ineligible for compensation under the Motor Accidents Compensation Act, he added.
This means that you can attend an illegal street race, be hit by one of the illegal street race cars and still get compensation. Seems like double standards to me. That is like going Skydiving and breaking a leg on the fall and claiming compensation isn't it?
